South African Residential evictions are governed by the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act 19 of 1998. PIE was enacted to regulate both the lawful eviction of unlawful occupiers and to recognise land owners’ rights to approach the courts for an eviction order. Although it has disposed of certain common law rights relating to eviction, its principles are deeply rooted in the Constitutional principles that no one may be evicted from their home, or have their home demolished, without an order of court.
